We at Vio, Inc. ("Vio," "we," "us," or "our") have created this privacy policy (this "Privacy Policy") because we know that you care about how information you provide to us is used and shared. This Privacy Policy applies to our information collection and use practices when you visit the www.adsend.com website (the "Website") and/or when you use the Adsend service (the "Service"). By visiting our Website and/or using the Service, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use, both of which govern your use of the Website.

  1. Safe Harbor Certification

    In light of the international nature of our business, Vio's privacy practices are self-certified to the Safe Harbor Program agreed to by the US Department of Commerce and the European Commission.   2. The Information We Collect

    1. Personal Information

    When you sign up to become a registered sender ("Registered Sender") and/or a register receiver ("Registered Receiver") in connection with the Service (collectively, a "Registered User"), you will be required to provide us with your name, address, phone number, e-mail address, and your company's name (collectively, the "Personal Information").

    2. Billing Information

    Registered Users may be required to provide a credit card number and/or similar payment information (collectively, the "Billing Information").

    3. Ads

    Registered Senders send us their advertisements ("Ads") for validation and transmission to publishers.

    4. Other Information

    In addition to the Personal Information, the Billing Information, and the Ads noted above that you voluntarily provide to us, we may collect additional information (collectively, the "Other Information"). Such Other Information may include:

    1. From Your Activity. Information that we or our technology providers may automatically collect when you visit the Website, such as your IP addresses, Internet service provider, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Website you visit, number of links you click while in the Website, and similar information concerning your use of the Website.
    2. From Cookies. Information that we or our technology providers may collect using "cookie" technology. Cookies are small packets of data that a website stores on your computer's hard drive so that your computer will "remember" information about your visit. We may use cookies to help us collect Other Information and to enhance your experience using the Website. If you do not want the Website to place a cookie on your hard drive, you may be able to turn that feature off on your computer.   3. How We Use and Share the Information

    We use the Personal Information, the Billing Information, the Ads, and the Other Information (collectively, the "Information") to provide our Services to you. We use the Personal Information and the Other Information to solicit your feedback and to inform you about our products and services and those of our Affiliated Companies (as defined below). Except as provided in the immediately previous sentence, we do not share, sell, rent, or vend your Information to any third party for marketing purposes.

We may share your Information within our family of companies, including, without limitation, Vio Worldwide Limited, Dubsat Pty Limited, Dubsat NZ Limited, Ambience Entertainment Pty, Ambience Concept Pty Limited, Omnilab Media Melbourne Pty Limited, and Omnilab Media Pty Limited (collectively, our "Affiliated Companies").
    2. Vio will access, use, and share the Information as required to fulfill its contractual obligations to you or subsequent requests for service and/or support by you. In so doing, Vio may outsource to third parties the Service or other services, in whole or in part, from time to time. Vio makes no independent use of the Billing Information or the Ads outside of what is needed to provide the Service.
    3. We may employ other companies and individuals to perform functions on our behalf. Examples may include providing technical assistance, order fulfillment, customer service, and marketing assistance. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law.
    4. In an ongoing effort to better understand our customers and our products and services, we may analyze the Other Information in aggregate form in order to operate, maintain, manage, and improve the Website and/or our products and services. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.
    5. If we or any of our Affiliated Companies (or all or substantially all of our assets or the assets of any of our Affiliated Companies) are acquired, we expect that the Information would be transferred along with the other business assets.

To the extent permitted by law, we may also disclose the Information: (i) when required by law, court order, or other government or law enforcement authority or regulatory agency; or (ii) whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of Vio or others.
  4. Accessing and Modifying Personal Information, Billing Information, and Communication Preferences

    Registered Users who have provided Personal Information and/or Billing Information may access, remove, review, and/or make changes to the same by e-mailing privacy@dubsat.com.au. In addition, Registered Users may manage their receipt of marketing and non-transactional communications by clicking on the "unsubscribe" link located on the bottom of any Vio marketing e-mail. Registered Users cannot opt out of receiving transactional e-mails related to their account with Vio. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases.

  5. How We Protect the Information

    We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. We use industry-standard SSL ("Secure Socket Layer") encryption technology, a secure server, and other physical and procedural safeguards to protect the security of the Information. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the Personal Information, the Billing Information, or the Ads that you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from the Website may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

  6. Important Notices to Non-U.S. Residents

    Vio abides by the principles set forth in the Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union. However, it is important to note that the servers that store the Information are operated in the United States. If you are located outside of the United States, please be aware that any Information provided to us will be transferred to the United States. By visiting the Website and/or using the Service, you consent to this transfer.

    In order to comply with the Safe Harbor framework, Vio commits to the resolution of complaints about your privacy and our collection or use of the Information. We have committed to resolve any complaints by European Union citizens relating to this Privacy Policy, which cannot be resolved directly with our company, through the Council of Better Business Bureaus, Inc.'s Safe Harbor Privacy Dispute Resolution Procedures.

    The Website may contain links to third-party websites. Vio has no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.

  8. Changes to This Privacy Policy

    This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. By accessing this Website and/or using the Service after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information.
